{"id":152,"date":"2014-05-07T11:34:19","date_gmt":"2014-05-07T11:34:19","guid":{"rendered":"http:\/\/phillipsonsconsultancy.com\/blog\/?p=152"},"modified":"2014-05-07T11:37:14","modified_gmt":"2014-05-07T11:37:14","slug":"still-on-the-enforcement-of-foreign-judgments-in-nigeria","status":"publish","type":"post","link":"https:\/\/phillipsonsconsultancy.com\/blog\/still-on-the-enforcement-of-foreign-judgments-in-nigeria\/","title":{"rendered":"Still on the Enforcement of Foreign Judgments in Nigeria"},"content":{"rendered":"<p>With rather coincidental timeliness following our <a title=\"recent blog entry\" href=\"https:\/\/phillipsonsconsultancy.com\/blog\/2014\/05\/enforcing-foreign-judgments-in-nigeria\/\" target=\"_blank\">recent blog entry<\/a> (also <a title=\"published elsewhere\" href=\"http:\/\/nigeriavillagesquare.com\/forum\/articles-comments\/83285-enforcing-foreign-judgments-nigeria-truly-ex-abundanti-cautela.html\" target=\"_blank\">published elsewhere<\/a>) on the enforcement of foreign judgments in Nigeria, our friend and Colleague <a title=\"Adewale Olawoyin\" href=\"http:\/\/law.unilag.edu.ng\/index.php\/personnel\/academic-staff.html?layout=edit&amp;id=23\" target=\"_blank\">Adewale Olawoyin<\/a> of the Nigerian law firm <a title=\"Olawoyin &amp; Olawoyin\" href=\"http:\/\/olawoyin.com\/\" target=\"_blank\">Olawoyin &amp; Olawoyin<\/a> has just published a very instructive article on the same topic in the <a title=\"Journal of Private International Law\" href=\"http:\/\/www.ingentaconnect.com\/content\/hart\/jpil\/2014\/00000010\/00000001\/art00006\" target=\"_blank\">Journal of Private International Law<\/a>.<\/p>\n<p>The article agrees with our conclusion in both the recent blog entry and <a title=\"'Gbenga Bamodu\" href=\"http:\/\/phillipsonsconsultancy.com\/people.htm\" target=\"_blank\">\u2019Gbenga Bamodu<\/a>\u2019s <a title=\"earlier similarly analytical article\" href=\"http:\/\/www.ingentaconnect.com\/content\/hart\/ouclj\/2012\/00000012\/00000001\/art00002\" target=\"_blank\">earlier similarly analytical article<\/a> in the <a title=\"OUCLJ\" href=\"https:\/\/www.law.ox.ac.uk\/publications\/past_issues.php\" target=\"_blank\">Oxford University Commonwealth Law Journal<\/a> that, contrary to the decisions of the Nigerian Supreme Court, the Foreign Judgment (Reciprocal Enforcement) Act 1960 really should be and continue to be inoperative until relevant orders are made by the Minister of Justice.<\/p>\n<p>\u2019Wale\u2019s article also goes on to make important observations and recommendations. Arguably, the most important of these is that the Nigerian legislature and policy makers should really be looking at enacting a new legislative regime for the enforcement of foreign judgments in Nigeria. The suggested new regime does not necessarily have to be based on reciprocity, it can take account of Nigeria\u2019s commercial and strategic interests especially bearing in mind which countries are Nigeria\u2019s most important trading partners, and it might even take account of non-money judgments . Finally, the new regime would obviate all the potential difficulties of interpretation that may attend both the Reciprocal Enforcement of Judgments Act 1922 and the Foreign Judgments (Reciprocal Enforcements) Act 1960.
